An Overview Of Recent Regulation Amendments In Continuing Airworthiness

A 5-day on-site activity took place from 14 to 18 October 2024 at Indian Aviation Academy, DGCA India New Delhi. The main objective was to review the regulations concerning continuing airworthiness and the entire process that led to the amendments of the rules, starting with the Notice of Proposed Amendment (NPA) and Regulatory Impact Assessment (RIA), followed by the Comment Response Document (CRD), issuance of the Opinion, and concluding with the publication of the final version of the rule, including the associated Acceptable Means of Compliance (AMC) and Guidance Material (GM).

The Workshop aimed to achieve the following:

  • Present the latest amendments to the EU Part-M, Part-CAMO, Part-ML, Part-CAO, Part-145, Part-66, and Part-147 Implementing Rules, and provide a briefing on the upcoming changes.

  • Highlight the differences between the existing corresponding rules in India (CAR-M, CAR-ML, CAR-CAO, CAR-145, CAR-66 and CAR-147) and the recently amended rules, which will enter into force on 1st January 2025.

  • Offer practical guidance to support the effective implementation of the new rules, addressing both industry and competent authority perspectives.

  • Facilitate discussions on the challenges faced by DGCA India regarding the implementation of the rules thus far.

  • Improve overall understanding of EU regulations and their development based on the safety risks identified in the European Aviation Safety Plan (EPAS).

 

The SARI expert began the session by outlining the process for amending regulations and fulfilling international obligations. DGCA India shared insights from their experience implementing Part-M in India, highlighting additional national requirements, industry size and complexity, SMS development, and key implementation challenges. The expert then provided participants with an overview of EASA implementing rules related to Part-M, including the latest revisions, amendments, and their background.

 

DGCA India officials received training on Part-CAMO and updates in EASA regulations for general aviation, including the GA Roadmap, Part-ML, Part-CAO, and CS-STAN. DGCA India shared presentations detailing the current status of general aviation in India, including industry size, complexity, and primary challenges in regulatory oversight. They also discussed their experiences implementing Part-145, covering aspects such as industry complexity, SMS maturity, and major implementation challenges.

 

The activity included expert briefings and discussions on EASA implementing rules for Part-145, the latest revisions and amendments, and their background. Topics covered included the EASA Management System Assessment Tool (MSAT), assessment of AMOs and CAMOs, EASA implementing rules for Part-66 and Part-147, recent updates, and interrelationships among various regulatory frameworks (e.g., between Initial and Continuing Airworthiness, Operations and Airworthiness, Part-145 and Part-147). The session also addressed procedures for competent authorities, including “Authority Requirements” and risk- and performance-based oversight.

 

The activity concluded with a review of regulatory amendments concerning change management. A total of 36 participants, including SARI AIR expert Mr Asmir Kruhovic, attended these sessions.
